THE HON'BLE Dr . JUSTI CE SHAMEEM AKTHER M.A.C.M.A.No.3 2 3 1 OF 2 0 0 5 JUDGMENT:

This appeal is filed under Section 173 of the Motor Vehicles Act, 1988 (for short, 'the Act'), by the appellants-claimants aggrieved by the order dated 05.04.2003 in O.P.No.1017 of 2000 on the file of the Motor Accident Claims Tribunal-cum-I Additional District Judge, Ranga Reddy District at L.B. Nagar, Hyderabad (for short, 'the Tribunal'). 2.

Heard the learned counsel for appellants-claimants, the learned counsel for 2nd respondent-Insurance Company and perused the record. The appeal against respondent No.1 was dismissed for default on 06.01.2012.

3.

Learned counsel for the appellants-claimants would contend that the Tribunal assessed the compensation payable to the claimants at Rs.4,04,000/ - and restricted the claim to Rs.3,00,000/ - as the claimants made claim to that extent only. 4.

According to the appellants-claimants, they are entitled for a compensation of Rs.3,00,000/ - on account of the death of Shaik Abdul Munaf, in a road accident, which occurred on 30.07.2000 due to the rash and negligent driving of the driver of the van bearing No.AP9T 4549. There is no infirmity in awarding Rs.3,00,000/ - as claimed by the petitioners-claimants. There are no merits to interfere with the order under challenge.

5.

In the result, the appeal is dismissed.

The Miscellaneous Petitions, if any, pending shall stand closed. No costs.
