Heard.
The petitioner is aggrieved by the inaction in hearing and disposal of Appeal No.1954/03, which is pending before the 2nd respondent. The petitioner states that he has filed the aforesaid appeal questioning the order of the 3rd respondent, dated 22-03-2003 in Case No.D/11018/202. but till date neither the date of hearing is fixed nor the said appeal is heard and disposed of.
Learned Government Pleader has obtained instructions, which confirm that the said appeal is still pending with the 2nd respondent. Since 12 years have passed, the appeal cannot any more remain pending without consideration by the 2nd respondent. Hence, the writ petition is disposed of directing the 2nd respondent to fix an early date for hearing of the appeal and after hearing the petitioner and any other party appearing in the said appeal, pass appropriate orders expeditiously, preferably within four weeks from the date of receipt of a copy of this order. No costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
