Learned counsel for the appellant seeks permission of this Court that the appellant may be permitted to withdraw the criminal appeal with a liberty to file appropriate fresh case.

Accordingly, the criminal appeal is dismissed as withdrawn with a liberty to file appropriate fresh case. Registry is directed to return the material papers to enable the appellant to file appropriate appeal. Pending miscellaneous petitions in the appeal, if any, shall stand closed.
