THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.2068 OF 2017 ORDER:

This petition is filed under Section 438 of Criminal Procedure Code (for short "Cr.P.C.") by accused No.7, apprehending his arrest, in Crime No.30 of 2017 on the file of Sullurpet Police Station, SPSR Nellore District, registered for the offence punishable under Sections 465, 451 and 506 read with 34 of Indian Penal Code (for short "I.P.C.") to direct the Station House Officer, Sullurpet Police Station to release him on bail in the event of his arrest in connection with the above crime. Sri Godey Satish, learned counsel for the petitioner, after arguing for a while, when this Court pointed out certain points in page No.2 of the complaint, he drawn the attention of this Court to ground No.8 of the bail application and requested this Court to direct the Station House Officer, Sullurpet Police Station to follow the procedure laid down in Section 41-A of Cr.P.C. and guidelines formulated by the Apex Court in "Arnesh Kumar v. State of Bihar and another1"

Acceding to the request of the learned counsel for the petitioner and considering the material available on record, without touching the merits, I deem it appropriate to direct the Station House Officer, Sullurpet Police Station to follow the procedure laid down in Section 41-A of Cr.P.C. and guidelines formulated by the Apex Court in "Arnesh Kumar v. State of Bihar and another" (referred supra).

With the above directions, criminal petition is disposed of. 1 (2014) 8 SCC 273

The miscellaneous petitions pending, if any, shall also stand closed.
