This Criminal Petition is filed under Sections 437 and 439 Cr.P.C. seeking to enlarge the petitioner/Accused No.1 on regular bail in connection with Crime No. 152 of 2023 of P.S.Nacharam, Rachakonda for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B), 27 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (Amendment Act, 2001).

Heard Sri Ajay Kumar Madisetty, learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State.

The case of prosecution is that on 14.03.2023 at open Plot No.60, Road No.2, Gokul Nagar, Mallapur, petitioner/Accused No.1 was found in possession of one cover containing 50 grams Charas, 7 covers each containing 10 grams of charas(total 120 grams), 01 cover containing 04 LSD Small papers and one-plus mobile phone and some other quantities of Charas was also recovered from the possession of A2 to A4. Basing on the said seizure panchanama, the
present crime is registered for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B), 27 of Narcotic Drugs and Psychotropic Substances Act, 1985(Amendment Act, 2001)against the petitioner/Accused No.1 along with others. 4.
Learned counsel for petitioner/Accused No.1 submits that major part of the investigation is completed and that the other accused No.2 to 4 were already enlarged on bail. He further submits that the petitioner is ready to cooperate with the investigation, and the case of the petitioner may be considered for grant of bail.

On the other hand, learned Additional Public Prosecutor opposing grant of bail submits that though major part of the investigation is completed, they are awaiting for the FSL report.

A perusal of the record shows that A2 to A4 are already enlarged on bail, and that major part of the investigation is completed, except for the FSL report even as per the prosecution. Therefore, this Court deems it appropriate to grant bail to the petitioner.

Accordingly, this Criminal Petition is allowed and the petitioner/accused No.1 is granted bail subject to the following terms and conditions:
(1) The petitioner/accused No.1 shall be released on bail on his executing a personal bond for Rs.20,000/- (Rupees Twenty thousand only) with two sureties each to the like sum to the satisfaction of the learned Magistrate concerned.
(2) The petitioner shall personally appear before the investigating officer on each Saturday between 10 a.m. and 2 p.m. till the completion of investigation and filing of charge sheet. Thereafter, the petitioner shall personally appear before the Court concerned on each date of hearing.
(3) The petitioner shall co-operate with the Investigating Officer in investigating the case.

Consequently, miscellaneous applications, if any, pending, shall stand closed.
