THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.8974 OF 2018 Dated:19.03.2018 Between:
Uppu Madhukar Rao, S/o. Narsing Rao Joshi, Aged about 69 years, Occ: Retd.
Govt. Servant, R/o. Sriramnagar, Kanapur (V) & (M), Nirmal District, Telangana State .. Petitioner And The State of Telangana, rep., by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.8974 OF 2018 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. 2.
Petitioner alleges that in the year 1968, he was given Lavoni Patta Certificate for the land admeasuring Acs.4.00 in Survey No.170 of Thimmapur Sivar, Khaapur Mandal, Nirmal District. He further alleges that his name was reflected in the revenue records and was in possession and enjoyment of the said land till 1981. However, in the year 1981, the Government Offices and Hostel were constructed on the very same land. According to petitioner, the said illegal action was questioned before this Court. But, he could not pursue the Writ Petition as he was doing Government job. He now claims that he is entitled to compensation of Rs.10,00,000/- for the said land, which was illegally taken possession by the Government.
3.
The averments in the affidavit filed in support of the Writ Petition are vague as to how the Government undertook construction of Government buildings and hostel. Even assuming that such construction was made illegally without resuming the land, petitioner could not have filed this Writ Petition after 27 long years claiming compensation. Delay and laches are staring on the face of this case. Further, petitioner claims that a Writ Petition was filed, but unable to furnish the basic details such as case number, relief sought and result of the case. Even otherwise, the claim of
compensation for alleged resumption of land in the year 1981 cannot be granted at this stage.
4.
The Writ Petition is accordingly dismissed. There shall be no order as to costs.
Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
