HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.8964 of 2018 ORDER:

1) Heard.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in seizing the petitioner's lorry (tipper) bearing No.AP28 X 7753 and handing over custody of the said vehicle to the third respondent, as illegal and arbitrary. 3) A counter came to be filed by the second respondent stating that the show cause notice was issued on 23.03.2018 to the owner of the vehicle demanding payment of tax and penalty of Rs.1,20,540/- and compounding fee of Rs.24,025/-. Pursuant thereto, it is stated that the petitioner submitted his explanation on 28.03.2018. 4) Having regard to the above, the authorities shall pass appropriate orders, within a period of ten days from today, relating to tax to be paid and also as to the release of the vehicle, at the earliest.

5) With the above direction, the writ petition is disposed of.
