THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3493 of 2016 ORDER:
1. This Criminal Petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in S.T.C.No.251 of 2012 on the file of the VI Additional Munsif Magistrate, Guntur.

It is alleged that the petitioner is carrying on manufacturing process in the premises of the factory without applying for registration and grant of licence and he contravened the provisions of Sections 6, 21, and 112 and Rules 4(1)(6) and 103 of the Factories Act.

It is stated in the petition that while the matter was coming for examination of the petitioner under Section 313 Cr.P.C., the petitioner could not appear before the trial Court and therefore, NBWs were issued against him. It is further stated that the petition filed by the petitioner to recall NBWs is being adjourned from time to time.
4. Considering the facts and circumstances of the case and since it is stated that the application filed by the petitioner before the trial Court to recall NBWs issued against him is pending and it is being adjourned from time to time, the trial Court is directed to consider the application filed by the petitioner and recall NBWs issued against him on condition of his executing a personal bond for a sum of Rs.1,000/- (Rupees One Thousand only) with one surety for the like sum to the satisfaction of the trial Court.
