HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 11604 of 2012 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the main writ petition is heard at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not issuing patta to the petitioner in respect of land admeasuring ac.0.50 cents in Sy.No.80 situated at Annavaram Village, Shankhavaram Mandal, East Godavari District, as illegal and arbitrary; and consequently direct the respondents to issue patta in favour of the petitioner in respect of the above said land. Though the learned counsel for the petitioner raised various grounds in the writ petition, but he restricts his prayer seeking a direction to the first respondent to pass orders on the representation made by the petitioner as he is in possession over the said land since last 20 years and cultivating the same.

The Government Pleader for Revenue submits that the request of the petitioner may be directed to be considered in accordance with law. Having regard to the facts and circumstances of the case and without going into the merits of the case, the writ petition is disposed of directing the first respondent to dispose of the representation, dated 18.07.2011, made by the petitioner seeking issuance of patta/assignment of land admeasuring Ac.0.50 cents in Sy.No.80 situated at Annavaram village, if it is still pending, in accordance with law, within a period of six (06) weeks from the date of receipt of a copy of this order. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
