HON'BLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION No.1953 of 2018 ORDER:

Heard learned counsel for revision petitioner. The parties to the revision are husband and wife. F.C.O.P.No.20 of 2015 is filed by the petitioner herein for grant of divorce. The respondent filed I.A.No.31 of 2018 to reopen trial and permit her to lead evidence. It is not in dispute that the O.P. was posted for arguments, after closing the evidence of respondent.

The trial court, after taking note of circumstances including to afford an opportunity to respondent herein, allowed the application.

The dispute is a matrimonial dispute. May be that the respondent was not diligent or suffering from complacency in conducting trial. Since the Family Judge has exercised the discretion, which is to further the cause of fair trial, this Court is not persuaded to interdict with the order impugned in the Civil Revision Petition.

The Civil Revision Petition fails and is accordingly dismissed. No order as to costs.
