THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.6623 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue an appropriate writ or order or direction more particularly one in the nature of writ of Mandamus declaring the action of the Respondents in not paying the leave salary to the petitioner for the sick period from 17.05.2014 to 05.11.2014 pursuant officer order No.E1/430(2)/2014-WST dated 06.07.2015 of the 2nd Respondent, is arbitrary, unjust, contrary to APSRTC Employees (Leave) Regulations, 1963, discriminatory and in violation of Article 14 and Article 21 of the Constitution of India and consequently direct the Respondents to draw and pay the leave salary to the petitioner for the sick period from 17.05.2014 to 05.11.2014, in the interest of justice and fair play and pass such other order or orders, just and necessary in the circumstances of the case.."

2. Heard Sri A. G.Satyanarayana Rao, learned counsel, appearing for the petitioner and Sri A.Rama Rao, learned Standing Counsel, appearing for the respondents.

During the course of hearing, it is brought to the notice of this Court by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 21.01.2016 to the 2nd respondent. It is further requested by the learned counsel for the petitioner that necessary directions may be issued to the 2nd respondent to pass appropriate orders on the representation submitted by the petitioner herein, in accordance with law, by fixing some timeframe. The said request is not opposed by the other side.

For the aforesaid reasons, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 2nd respondent to pass appropriate orders on the representation dated 21.01.2016 said to have been submitted by the petitioner herein, in accordance with law, within a period of two months from the date of receipt of a copy of this order.

5. With the above directions, the Writ Petition is allowed. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 15.03.2016 SS
