HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.10854 OF 2019 ORDER:

This writ petition is filed with the following prayer: "...to issue an order or direction more particularly one in the nature of writ of mandamus or any other appropriate writ declaring the action of the respondents No.3/4, in calling the petitioner to the police station and to hand over all the original documents belong to the land admeasuring 12100 sq.yards equal to Ac.2.20 gts in Sy.No.669/12, situated at Nagunur Village, of Karimnagar Mandal, and has to withdraw the suit filed by him in O.S.No.24 of 2019 on the file of Hon'ble I Additional District Judge at Karimnagar and shall not make any obstruction if the respondents No.5 and 6 along with their men enters into the land of the petitioner and does any activities, otherwise the petitioner has to face dire consequences in the hands of respondent No.

3/4 as well as in the hands of the respondent No.2, is nothing but arbitrary, illegal, null and void, and violative of principles of natural justice and also violative of Articles 14, 19, 21 and 300A of the Constitution of India. Consequently direct the respondents No.3/4, not to harass and not to interfere in the civil disputes and not to threaten the petitioner to withdraw the civil suit filed by him, and to pass such other order or orders as this Hon'ble court may deem fit and proper in the interest of justice."

Learned Assistant Government Pleader for Home produced written instructions stating that Cr.No.212 of 2019 is registered against the petitioner on 01-06-2019 under Sections 420 and 506 IPC. It is also stated that the respondent-police are not pressurizing or interfering with the civil disputes.

Except registration of crime and investigating the matter, other allegations of the petitioner are denied.

Recording the same, the writ petition is disposed of. However, it is open for the petitioner to avail remedy available to him in accordance with law.
