THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14651 OF 2011 ORDER:
The case of the petitioner is that he is the absolute owner and possessor of the open plot situated at Sy.No.1231, Ramnagar, Karimnagar to the extent of 363 sq.ys having purchased the same from S.Kanakamallaiah through a registered document bearing No.5732/2001 on 28.09.2001. The petitioner also constructed the basement wall in the said plot with a view to construct a house. While so, the respondent authorities on 20.05.2011 came to the petitioner's plot and demolished the basement wall with a view to dug a drainage canal through the petitioner's plot. The respondent Corporation neither intimated nor issued any prior notice before demolishing the petitioner's plot. Aggrieved by the same, present writ petition is filed.
Though this Court granted interim order on 31.05.2011, the same is extended upto 11.06.2012. Thereafter, there is no extension of interim order.
Sri V.Satyam Reddy, Learned Standing Counsel for respondent municipality on instructions submits that the drainage canal is already laid.
In view of the above, the cause in the writ petition does not survive since the drainage canal is laid in the petitioner's property. However, it is open for the petitioner to initiate appropriate proceedings for claiming compensation after establishing his right and title over the said property.
Accordingly, the writ petition is disposed of. No order as to
costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
