THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No.20032 of 2002 ORDER:

When the matter is taken up for hearing, none appeared for the petitioner, inspite of the fact that the matter is listed under the caption " For Dismissal" .

A perusal of the record would disclose that the petitioner has filed the writ petition seeking a writ of mandamus declaring the impugned order passed by the 1st respondent date 20.2.2002 as arbitrary, illegal and contrary to G.O.Ms.No. 38, dated 31.01.1996 and G.O.Ms.No. 175, dated 29.05.1997, read with proceedings dated 29.09.1997 of the 1st respondent-University, and for a consequential direction to the respondents to release the medical reimbursement amount to the petitioner forthwith.

The petitioner is claiming medical reimbursement of an amount of Rs.12,251/ - incurred for the treatment he had undergone at L.V.Prasad Eye Institute. The respondents have negatived his request, vide proceedings dated 20.02.2002, on the ground that he was not referred by any teaching hospital and also by NIMS, Hyderabad. 4.

This Court, having considered the said submission, is of the considered view, that this writ petition can be disposed of, directing the petitioner to submit a representation seeking medical reimbursement, within one week from the date of receipt of a copy of this order, and upon such a representation being received, the respondents shall reconsider and pass appropriate orders in another four weeks.

There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
