This Criminal Petition is filed under Section 482 of the Code of Crimina-l Procedure, 1973 (for short 'Cr.P.C.J by the petitioner/Accused No.l to quash the proceedings against him in Crime No.58 of 2023 on the file of Station House Ofhcer, Tirumalghery Police Station, Hyderabad The offences alleged against the petitioners under Sections 406 and 29O of the Indian Penal Code and Section 3 (l) (r) of the Scheduled Castes and the Scheduled Tribes I t!
(Prevention of Atrocities) Act, 1989.
02. Heard learned counsel for the petitioner and { I learned Additional Public Prosecutor for the respondent No. 1 - State.
03. On perusal of the record, since the punishment prescribed for the offences alleged again st the petitioners are up to seven years, this Court deems it appropriate to direct the Investigating Oflicer in Crime No.58 of 2023 on
-- the file of Station Housc Officer, Tirumalghery Police Station, Hyderabad, to follow the procedure laid down under Section 4l -A Cr.P.C., and also the guidelines formulated by the Hon'ble Supreme Court in Arnesh Kumar v. Stdte of Biharrscrupulously. The petitioner shall co-operate with the Investigating Offrcer in concluding the investigation.
