THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9450 of 2016 ORDER:

This Criminal Petition is filed by the petitioner, under Section 438 of the Criminal Procedure Code, seeking anticipatory bail in an un-numbered crime on the file of Women Police Station Gachibowli, Hyderabad.

The case of the petitioner is that his marriage with one S.Prashanti in the year 2008 and they blessed with two children. Due to differences between them, said Prashanti left her matrimonial house and filed a complaint against the petitioner and his mother in the Women Police Station, Gachibowli.

Hence, the petitioner is apprehending arrest in the hands of the police. Learned Additional Public Prosecutor submitted that no case is registered against the petitioner in the above said police station and therefore, there is no apprehension of arrest of the petitioner. In view of the above submission of the learned Additional Public Prosecutor, this criminal petition is not maintainable and accordingly, the same is dismissed.
