HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9671 OF 2015 ORDER:
This Criminal Petition is filed by the petitioner/accused under Section 482 Cr.P.C seeking to quash the proceedings in crime No.330 of 2015 of Bowenpally Police Station, Hyderabad District, registered for the offence punishable under Sections 354 and 341 I.P.C.
Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the State and before notice to respondent No.2/de facto complainant and before admission.
The learned Public Prosecutor opposed the application stating that the accused is wanted person, who involved in four crimes i.e., 1) crime No.356 of 2009 of Bowenpally Police Station registered for the offence punishable under Sections 444, 427, 290, 323, 504, 506 I.P.C.; 2) crime No.114 of 2010 of Bowenpally Police Station registered for the offence punishable under Sections 307, 387, 342 I.P.C.; 3) crime No.475 of 2010 of Bowenpally Police Station registered for the offence punishable under Sections 324, 420, 290, 506 I.P.C;
4) crime No.54 of 2013 of Bowenpally Police Station registered for the offence punishable under Sections 447, 427 and 506 I.P.C Perused the material on record. The facts fall short for this Court to admit the application for quashing of F.I.R. However, the factual matrix show the entitlement of concession of bail.
No doubt, there are four more crimes in which the petitioner has shown involved in the said crimes relate to the years 2009, 2010 and 2013. It is not even shown any final report filed in the above said crimes or still under investigation. Needless to say, if any interrogation is required, the learned Magistrate shall grant bail and take care of imposing necessary conditions. Having regard to the above, this criminal petition is disposed of giving liberty to the petitioner to surrender before the learned Magistrate concerned and move for regular bail with notice to the Additional Public Prosecutor and in such an event the learned Magistrate shall hear and grant bail on the same day
with necessary conditions including any condition of requirement of the petitioner for interrogation.
