HON'BLE SMT. JUSTICE K.SURENDER CRIMINAL PETITION No. 2901 of 2022 O R D E R:

This Criminal Petition under Section 439(1)(b) Cr.P.C., is filed seeking relaxation of the condition imposed by the Court below, by order dated 04.01.2022 in Crl.M.P.No.370 of 2021 in Crime No.194 of 2021 on the file of Special Judge for Fast Tracking the cases relating to Atrocities against Woman-cum-VI Additional Sessions Judge, Adilabad, directing the petitioner/Accused to appear before the Station House Officer concerned between 12 Noon and 3 P.m on every Tuesday, Thursday and Saturday till the victim gets examined as prosecution witness.

Learned counsel for the petitioner, Mr.Kondadi Ajay Kumar submits that the petitioner is complying with the condition regularly, which is not disputed by the learned Assistant Public Prosecutor, and as the petitioner is a resident of Hyderabad and he is facing hardship in attending the Police Station at Hijapur, which is 300 Kms away. Learned counsel submits that the petitioner is ready to cooperate with the investigation and the said condition may be relaxed.

In view of the said submissions and taking into consideration the fact that the petitioner is complying with the conditions regularly, this Court deems it appropriate to modify the said condition by directing petitioner/Accused to appear before the Station House Officer concerned once in a month i.e., on every 2nd Saturday, until completion of the evidence of the victim girl as stated in Criminal Petition No.370 of 2021.

With the above modification, this Criminal Petition is disposed of.
