THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY SA MP No.1966 OF 2016 IN/AND SECOND APPEAL No.851 OF 2016 JUDGMENT:

SAMP No.1966 of 2016, under Rule 3 of Order XXIII read with Section 151 of the Code of Civil Procedure, 1908, is filed seeking permission of this Court to enter into compromise among the parties to the appeal.

Both parties are present except respondent No.6 against whom the appeal is not pressed by the counsel for the appellant and they are identified by their respective counsel. Except respondent No.6, all others stated that they entered into compromise. Compromise terms are explained to them and they admitted as true and correct and the same is out of free volition.

Therefore, I find that it is a fit case to grant permission to enter into compromise, since it is voluntary, except respondent No.6.

Accordingly, the SAMP is allowed and the second appeal is disposed of in terms of compromise except respondent No.6. The second appeal against respondent No.6 is dismissed as not pressed. The terms of the award shall form part of the Judgment. No costs.

Miscellaneous petitions, if any, pending in the second appeal, shall stand closed.
