THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2764 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/Accused on bail in connection with Crime No.81 of 2022 on the file of Station House Officer, Gandhi Nagar Police Station, Hyderabad registered for the offences punishable under Sections 498-A and 306 of Indian Penal Code (IPC). 2.

Heard Sri D.Ramakrishna, learned counsel for the petitioner/Accused, the learned Assistant Public Prosecutor for the respondent-State and perused the record.

Petitioner is arrayed as sole Accused in the aforementioned Crime.

The facts of the case are that on 04.03.2022 a complaint was received by the elder sister of the deceased namely Sri Devi @ Chandu stating that the deceased was married in the year 2013 and blessed with two children namely C.Vignesh and C.Rudraansh aged 8 years and 5 years respectively. The petitioner/Accused used to

harass the deceased physically and mentally, frequently sent her to her mother's place. There was a panchayath held as the petitioner/Accused threatened to give divorce to the deceased. Since the harassment continued, it is alleged that unable to bear the harassment, the deceased committed suicide by hanging herself. 5.

Learned counsel for the petitioner/Accused submits that the petitioner is in jail since 05.03.2022 and there are no specific allegations against the petitioner/Accused except making bald allegations about harassment. Learned counsel further submits that the deceased prior to her death has written a note that "nobody is responsible for her death and asked to forgive her". The said note is in the writing of the deceased which is not disputed by the prosecution.

Learned counsel further submits that the petitioner/Accused has to look after his two children and he is ready to abide by any conditions imposed by this court in the event of grant of bail.

In the above circumstances, this court is inclined to grant bail to the petitioner/Accused.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions: i) The petitioner/Accused shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with two sureties for a like sum each to the satisfaction of X Additional Chief Metropolitan Magistrate at Secunderabad.

ii) The petitioner/Accused shall appear before the investigating authorities on every Saturday between 08.00 AM and 11.00 AM for a period of three (03) months or till filing of the charge sheet, whichever is earlier.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
