THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.1800 OF 2014 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for respondents 1 to 5. The prayer sought in the Writ Petition is as under:- "...to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus, to declare the inaction of respondent Nos.2 to 5 in taking action on complaint dt. 26.12.2013 submitted by the petitioner for taking action against the unofficial respondents who have committed the theft of some goods worth Rs.3,37,456.74 ps from consignment No.44 dt. 19.11.2013, as being illegal and arbitrary, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

During the course of hearing, learned Government Pleader placed on record written instructions dated 28.10.2019 issued by the Sub-Inspector of Police, Medchal P.S., Cyberabad Commissionerate.

From a perusal of the written instructions, it is revealed that basing on the private complaint, a case in Crime No.137 of 2013 for the offence under Section 379 of the Indian Penal Code was registered on the file of Chennakothapalli Police Station, Ananthapur, on 14.12.2013. It is also further mentioned that on reliable information, it was disclosed that the case was closed as undetected on 31.10.2015.

In that view of the matter, no further cause would survive in the Writ Petition and the Writ Petition is liable to be closed.

Accordingly, the Writ Petition is closed. However, liberty is given to the petitioner to pursue the remedies available to him under the Code of Criminal Procedure.

There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand closed. ______________________ (P.KESHAVA RAO, J) 13th November 2019 RRB
