Heard learned counsel for the petitioner and learned counsel for the respondents.

It is the case of the petitioner that he filed I.A.No.80 of 2021 in O.S.No.278 of 2002 before the Junior Civil Judge, Kollapur to allot the shares of the deceased petitioner among the petitioners, but the same was dismissed on 17.02.2021 on the ground that the case is at the stage of preliminary decree. Aggrieved by the same, the present revision is filed.

Learned counsel for the respondent opposed on the ground of resjudicate and that the order passed by the trial Court is just and proper and needs no interference of this Court. 4.

Accordingly, this revision petition is dismissed confirming the order dated 17.02.2021 passed by the Junior Civil Judge, Kollapur in I.A.No.80 of 2021 in O.S.No.278 of 2002 giving liberty to the petitioner to take appropriate steps, in accordance with law, if so advised, at appropriate stage.
