HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT W.P.No.32420 OF 2015 PC: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

The petitioner impugns Note No.3 published along with notification dated 12.09.2015 by which a list of registration numbers of candidates was declared as qualified in the screening test conducted on 08.03.2015. Note No.3 appended to the notification states that "the application of the candidate bearing Regd. No.3432 is rejected as he is over aged."

It is not in dispute that registration No.3432 is of the petitioner and it was wrongly mentioned in the Note as 'he' instead of 'she'. The petitioner admits that she was over aged on the relevant date. In other words, the petitioner admits that she was not eligible to apply to the post of Junior Civil Judge being over aged. It is also pertinent to note that when the hall tickets were issued, it was made clear to all candidates that scrutiny of the applications will be done after the declaration of result of screening test and their candidature would be subject to fulfillment of the criteria mentioned in the advertisement. In the advertisement, the age prescribed for the category from which the petitioner applied for the post was 40 years and on the date of application, her age was 40 years 9 months. In the circumstance, we find no substance in the writ petition. Petition is dismissed.

Consequently, miscellaneous petitions, if any pending, also stand disposed of.
