HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.1610 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for respondent Nos.1 to 3.

The prayer sought in the writ petition is as under: "... to issue an appropriate writ more particularly one in the nature of writ of Mandamus declaring the action of respondents 2 and 3 in not investigating into the crime No.37 of 2015 on the file of 3rd respondent and not seizing the passport of 5th respondent bearing No.K7404000 to secure his presence in connection with the Crime No.37 of 2015 on the file of 3rd respondent as being illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents 1 and 3 to take necessary steps including seizure of passport No.K7404000 of 5th respondent to secure his presence in Crime No.37 of 2015 on the file of 3rd respondent." During the course of arguments, it is brought to the notice of this Court by the learned Government Pleader that the investigation in Crime No.37 of 2015 on the file of the 3rd respondent police station is completed and charge sheet has already been filed on 05.11.2015.

Further, the writ petition being W.P.No.1053 of 2017 filed by the 5th respondent herein was disposed of by this Court on 06.01.2017. A perusal of the said order would indicate that the 5th respondent and the petitioner herein settled the issue and the 5th respondent intends to come to India from United States of America for execution of settlement deed. Therefore, the lock out circular issued against the 5th respondent herein in C.C.No.511 of 2015 on the file of the XIII Additional Chief Metropolitan Magistrate, Hyderabad, was re-called. In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition.

Accordingly, the writ petition is closed. No order as to costs. Miscellaneous petitions, if any, shall also stand closed. ___________________ P. KESHAVA RAO, J Date: 30.08.2019.
