THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.5455 OF 2010 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to declaring the action of the 2nd respondent in not considering the representation dated 15.6.2009 made by the petitioner for grant of police protection to cultivate the plaint schedule lands is not legal and arbitrary, consequently direct the 2nd respondent to grant police aid to the petitioner to cultivate the schedule lands."

The main grievance of the petitioner is that respondent No.2 is not providing police protection to her to cultivate the schedule lands even though she obtained an interim order of injunction from the competent civil Court in a suit.

On 10.03.2010, this Court passed an interim order in W.P.M.P.No.7016 of 2010 directing respondent No.2 to provide police protection to the petitioner for implementation of the said injunction order. Learned counsel for the petitioner submitted that the suit is still pending and the injunction order is also in existence.

Considering the facts and circumstances of the case, the interim order passed by this Court on 10.03.2010 in W.P.M.P.No.7016 of 2010 is made absolute and respondent No.2 is directed to provide police protection to the petitioner as far as the interim order of injunction exists in her favour.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
