Mekala Raju, v. The State Of Telangana Rep ,
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.8944 OF 2018 Dated:19.03.2018 Between:
Mekala Raju, S/o. Late Gattaiah, Aged 33 years, Occ: Business, Residing at H.No.18-4-278, Addaguntapally, Godavarikhani Mandal, Ramagundam of Peddapally, Karimnagar District .. Petitioner And The State of Telangana, rep., by its Principal Secretary (Revenue Department), Secretariat Complex, Saifabad, Hyderabad and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.8944 OF 2018 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for respondents 1 to 6. 2.
Grievance of the petitioner in necessitating institution of this Writ Petition is, after obtaining injunction order from the trial Court, he made a representation to include the land in Survey No.811/B of Jangaon Shivar of Godavarikhani in RED mark list. However, the same is not done and the opposite party is attempting to register the property in favour of third parties.
3.
Reliance is placed on the order dated 31.08.2016 passed by the Principal Junior Civil Judge at Godavarikhani in I.A.No.36 of 2016 in O.S.No.12 of 2016. A reading of the said order would show that the Court directed maintenance of status quo by both the parties until further orders. However, the order does not contain the details of the property on which the status quo was directed to be maintained. In the absence of clarity with regard to the property details, the Registrar cannot be compelled to act on the representation filed by the petitioner and such course of action may create further complications. Thus, no direction as sought for by the petitioner can be grated.
4.
The Writ Petition is accordingly dismissed leaving it open to the petitioner to seek appropriate clarification/orders from the trial Court in the pending suit. There shall be no order as to costs.
Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
