THE HON'BLE JUSTICE G.SRI DEVI Criminal Petition No.2922 of 2019 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners seeking a direction to the Station House Officer, Huzur Nagar Prohibition & Excise Station, Suryapet, to release the CB Unicorn Motor Cycle bearing Registration No.TS-05-AD-TR-3084 bearing Chasis No.ME4K311JJ8398679 and Engine No.KC31E-8-0398613, which was seized in connection with P.R.No.49 of 2019.

2. Heard both sides and perused the record.

3. During the course of arguments, learned counsel for the petitioner confines his prayer and submits that permission may be accorded to the petitioner to file an application before the appropriate authority, within a stipulated time, seeking release of the vehicle.

4. In view of the said submission, this Criminal Petition is disposed of with a direction that if the petitioner files an application, within a period of fifteen days from the date of receipt of a copy of this order, before the appropriate authority seeking release of the vehicle, the same shall be considered and disposed of by the appropriate authority at the earliest, in any event not later than two weeks from the date of filing of such application, in accordance with law and after affording an opportunity of hearing to the petitioner to putforth his case.
