THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.3517 of 2015 ORDER:
The petitioners, who are A-1 to A-5 and A-11 to A-14, in Cr.No. 210 of 2014 of Renigunta Police Station, Chittoor District filed the present petition under Section 437 and 439 Cr.P.C. seeking enlargement on bail in the above crime registered for the offence punishable under Sections 353, 307, 379, 120-B r/w Section 34 of IPC and Section 20(1) (C) (ii) (iii) (iv) (x), Section 29(ii) (B) of A.P.Forest Act, 1967 and Section 3 of A.P.Red Sandal Wood Possession Rules, 1989, and Section 51 of Wild Life (Protection) Act, 1967 and Section 55(2) of Biological Diversity Act. A charge sheet came to be filed against the petitioners and 16 others for the above mentioned offences.
The very same petitioners filed Crl.P.No.2146 of 2015 seeking bail, which was rejected not only on the merits but on the ground that the petitioners are residents of Tamil Nadu and if they are released on bail, there is every likelihood of they evading the process of law.
Learned counsel for the petitioners submits that the accused who stand on the same footing as that of the petitioners and residents of Tamil Nadu were granted bail by the learned Sessions Judge. But no orders are placed before this Court. As such, I am not inclined to grant bail to the petitioners. However, the petitioners, if so, advised shall make an application before the Sessions Court, which shall be dealt with in accordance with law uninfluenced by the order passed by this Court.
