THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.8924 OF 2018 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring the action of Respondents in proceeding to form Parthunaik Thanda presently under Kondrapol Grampanchayath Damaracherla Mandal, Nalgonda District as New Grampanchayath without following the procedure laid down under the Panchayath Raj Act and also the Telangana Grampanchayath (Declaration of Villages) Rules, 1994 without considering the objections through Representations Dated 23.01.2018 and 08.02.

2018 as arbitrary, illegal, unjustified and in violation of the provisions of Panchayath Raj Act and also the Telangana Grampanchayath (Declaration of Villages) Rules, 1994 and consequently direct the Respondents to follow the procedure laid down under Panchayath Raj Act and also the Telangana Grampanchayath (Declaration of Villages) Rules, 1994 for formation of Parthunaik Thanda as New Grampanchayath by considering the objections raised by the Petitioners vide Representations Dated 23.01.2018 and 08.02.2018 and include the Ooracheruvu into newly proposed Parthunaik Thanda."

Heard learned counsel for the petitioners, learned Government Pleader for Panchayat Raj (TG) appearing for respondent Nos.1 and 2 and the learned Government Pleader for Revenue (TG) appearing for respondent Nos.3 to 5. 3.

According to the petitioners, for redressal of their grievance, the petitioners submitted representations on 23.01.2018 and 08.02.2018 to the respondents herein but no action has been taken by the respondents on the said representations. It is also the grievance of the petitioners in the present writ petition that in

deviation to the procedure, the respondent authorities are resorting to the impugned action.

Having heard the learned counsel for the petitioners and the learned Government Pleaders, and taking into consideration the nature of controversy, this Court deems it appropriate to dispose of the present writ petition with a direction to respondent No.3 to consider the representations, dated 23.01.2018 and 08.02.2018, said to have been submitted by the petitioners herein and pass appropriate orders strictly in accordance with law within a period of one month from the date of receipt of a copy of this order after giving opportunity of personal hearing to the petitioners herein. 5.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
