THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11954 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "The Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd Respondent in accepting the letter Dt:08.05.2015, submitted on behalf of the petitioner, expressing the intension of the management of the petitioner's school to close the institution on account of lack of strength of the students, lack of admissions and unviability of the financial status of the petitioner's institution is arbitrary, ultravirus and violative of Article 14 of Constitution of India and consequently direct the 2nd respondent to accept the proposal of the petitioner submitted vide letter dt:08.05.2015 for closure of the school w.e.f. academic year 2016-17 and pass such or further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

As the petitioner claims that its representation dated 08.05.2015 is pending consideration before the District Educational Officer, Chittoor District, this Court sees no reason to entertain this writ petition for adjudication on merits. It is for the authority concerned to apply its mind to the request made by the petitioner and take appropriate action thereon in accordance with law.

The writ petition is accordingly disposed of directing the authority concerned to consider the petitioner's representation dated 08.05.2015 in accordance with law and take appropriate action thereon. In the event the petitioner's request is rejected, the reasons therefor shall be recorded and duly communicated to it. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
