THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.9154 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking a direction to the respondents to conduct investigation into Crime No.206 of 2013, on the file of the Badvel Police Station and complaining against the failure of the Investigating Officer to file a charge sheet for punishing the persons, who are responsible for the missing of the son of the petitioner. 2.

I have heard the submissions of Sri Kothapally Hari Krishna, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (A.P.) appearing for the respondents 1 to 4. I have perused the material record.

While narrating the contents of the writ petition, the learned counsel for the petitioner would submit that the petitioner's son used to move closely with one Balaji, a Refrigerator mechanic and others and that the said persons, having observed that the son of the petitioner is having cash of Rs.15,00,000/- in his possession, have done some harm to the son of the petitioner, which is not known to the petitioner, and that the son of the petitioner is since then missing and that having registered a crime for Man Missing, the Police failed to take appropriate steps for investigation into the crime and, therefore, the writ petition is filed.

Learned Government Pleader, on written instructions, would submit that after the registration of the crime, the investigation was taken up and that since the petitioner suspected involvement of one Y.Venkat Kumar and 6 others in the matter of missing of his son, the

MSRM, J W.P.No.9154 of 2018 said persons were interrogated, but no clues were found and that thereafter, a requisition was made to the learned Magistrate to accord permission to conduct polygraph tests at State's Forensic Science Laboratory by subjecting the suspects to such tests, but the said request was rejected by the Court and that the progress of investigation is being informed to the higher authorities from time to time and that the Deputy Superintendent of Police, Women Police Station, Kadapa, conducted an enquiry and also verified the record of investigation so far done and that the higher authorities are satisfied that the investigation so far done is on the correct lines and that as on today, no clues are found and that further investigation is under progress and that as and when the investigation reaches a conclusion, a final report will be filed before the Court of the learned Magistrate by due adherence to the procedure established by law. 5.

Recording the submissions, the Writ Petition is disposed of directing the 4th respondent to complete the investigation, as expeditiously as possible, and file a final report by due adherence to the procedure established by law. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
