HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.20713 of 2017 ORDER:

At request of Assistant Government Pleader (Assignment), the writ petition was adjourned from 23.06.2017 to today, to enable him to get instructions.

2. The petitioner prays for the following relief: " ....writ of mandamus, declaring the action of the respondent Nos.2 to 5 in interfering with the petitioner's possession of land to an extent of Ac.3.03 cents in S.No.17/ 1 of Rajupeta, Ramakuppam Mandal, Chittoor District as illegal, improper and unconstitutional."

3. The petitioner relies upon the assignment patta dated 21.09.2007 and other revenue records maintained in the name of the petitioner for the subject matter of the writ petition. Now the grievance is respondents, particularly, 4th respondent is trying to physically dispossess the petitioner without recourse to law.

4. Learned Assistant Government Pleader on instructions submits that 4th respondent is not interfering with physical possession of the land in an extent of Ac.3.03 cents in S.No.17/ 1 of Rajupeta, Ramakuppam Mandal, Chittoor District and if at all any action is to be initiated for cancellation of patta or resumption of possession, the action will be strictly in accordance with law. The statement is placed on record and accepted.

5. The writ petition is disposed of accordingly. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
