THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4381 OF 2021 O R D E R :

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') by the petitioner/A1 to quash the proceedings against the petitioner in C.C.No.56/2017 on the file of the VIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad. The offences alleged against him are under Sections 498-A, 406, 06 of the Indian Penal Code and Sections 4 & 6 of the Dowry Prohibition Act.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for respondent State. Perused the record.

According to the 2nd respondent her marriage with the petitioner/A1 was taken place on 20.02.2014 at Tirupathi and thereafter, petitioner-husband started harassing for additional dowry. Subsequently, she went to USA along with her husband and there they were blessed with a son. However, due to constant harassment in the USA, the 2nd respondent came back to Hyderabad. Even at Hyderabad, she was subjected to

harassment.

Several allegations are leveled against the petitioner-husband herein.

In the said circumstances, this Court is not inclined to quash the proceedings against this petitioner. However, the Trial Court shall conclude the examination of witnesses and is at liberty to draw its own conclusion on the basis of evidence adduced during the course of trial.

Accordingly, the Criminal Petition is disposed off. Miscellaneous applications pending, if any, shall stand closed.
