As there was no representation for the appellant on 03.02.2016, the matter was directed to be listed under the caption "FOR DISMISSAL" on 04.02.2016.

2. Even today, despite the matter being listed under the caption "FOR DISMISSAL", there is no representation for the appellant. It appears that the appellant is not interested in pursuing the matter.

3. Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. Interim order granted by this Court on 27.12.2004 is vacated. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
