HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15517 of 2015 ORDER:
When the matter is taken up for hearing, it is noticed that the petitioners are challenging the action of the respondents in trying to dispossess them from their residential buildings situated on the back of Lakaram Tank without following the due process of law. Learned counsel for the petitioners contends that this Court was pleased to grant interim order on 04.06.2015 directing the respondents not to interfere with the possession of the petitioners without following the due process of law.
Learned Government Pleader appearing for the respondents contends that the interim order granted on 04.06.2015 may be made absolute and if the respondents intend to dispossess the petitioners from the land in question, they would do so by following the due process of law.
This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to follow the due process of law, if they intend to dispossess the petitioners from the land in question. With the above direction, the writ petition is disposed of. No order as to costs.
