THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13628 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioners/accused seeking grant of anticipatory bail in an unregistered crime on the file of the Eluru II Town Police Station, West Godavari District.

Heard and perused the records.

Learned counsel for the petitioners submits that on the allegation that the elder son of petitioners 1 and 2, namely Eadara Kasi Reddy, married some girls by committing fraud on them, the police have been regularly calling the petitioners herein to the police station.

Learned Public Prosecutor submits that no case is registered against the petitioners herein.

Considering the facts and circumstances of the case, the respondent/police is directed to follow the procedure laid down in Section 41-A of Code of Criminal Procedure (CrPC) prior to arrest of the petitioners herein. Further, the petitioners are at liberty to approach appropriate forum seeking appropriate relief on receiving summons from the respondent/police.
