Heard learned counsel for the petitioner and learned Assistant Government pleader.

Petitioner claims to be the owner and in possession of land admeasuring Ac.0.11 cents in Sy.No.222/1, Ac.0.69 cents in Sy.No.222/1, Ac.0.68 cents in Sy.No.222/3, Ac.0.73 cents in Sy.No.222/4, Ac.0.19 cents in Sy.N.222/5, and Ac.0.34 cents in Sy.No.222/6 of Kesavarayunipalem Village, Laveru Mandal, Srikakulam District. Petitioner is aggrieved by inclusion of said properties in the prohibited list of properties under Section 22-A

(1) (c) of the Indian Registration Act, 1908. Aggrieved by such inclusion, petitioner filed representation to the Commissioner, Endowments Department, State of Andhra Pradesh sent through registered post with acknowledgement and the same was received by the Commissioner on 22.02.2018. Alleging inaction on the said representation, this writ petition is filed.

Since the petitioner has already filed application for deletion of the land from the list of prohibited endowment properties and the said application is pending with the Commissioner, Endowments, this Court is not inclined to entertain the writ petition and keep the writ petition pending.

Having regard to the above, the Writ Petition is disposed of directing the Commissioner of Endowments, Gollapudi, Vijayawada (2nd respondent) to examine the claim of the petitioner for deletion of the subject properties from the list of prohibited endowment

- 3 - properties and to pass appropriate orders as warranted by law, within a period of three (3) months from the date of receipt of copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
