This Writ Petition is filed challenging the proceedings in No.W4/785(01)/2017-PO.I, dated 16.05.2017 issued by the 5th respondent wherein and whereby the application of the petitioner for compassionate appointment was rejected on the ground that the petitioner's father was found to be medically unfit and he retired from service and he also availed additional monetary benefit under Regulation 6A(5)(a) or (b) of APSRTC Employees' (Service) Regulations, 1964.

Heard learned counsel for the petitioner and Sri P.Durga Prasad, learned Standing Counsel for respondents. Learned Standing Counsel for the respondents submits that when once the petitioner's father availed additional monetary benefit under Regulation 6A(5)(a) or (b) of APSRTC Employees' (Service) Regulations, 1964 in lieu of employment, petitioner cannot claim compassionate appointment.

Learned counsel for the petitioner submits that the petitioner is not aware of the receipt of additional monetary benefit in lieu of employment.

A perusal of impugned proceedings dated 16.05.2017 goes to show that the father of the petitioner has received additional monetary benefit in lieu of employment, as such, the spouse or children are not entitled for compassionate appointment. Even in the affidavit, it is not disputed that the petitioner's father has not

availed additional monetary benefit in lieu of employment. The respondents' Corporation, relying on the APSRTC Employees' (Service) Regulations, 1964, rightly rejected the application of the petitioner and that no infirmity is brought to my notice in the impugned proceedings by the learned counsel for the petitioner. In view of above facts and circumstances, the Writ Petition is liable to be dismissed and accordingly dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in this writ petition shall stand dismissed.
