THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39991 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to call for the records in FIR No.141 of 2016 and to quash the same.

The allegations made in the present complaint lodged by the 3rd respondent against the petitioner are that on 04.09.2016 at 12.30 hours at toddy hurt, near Bus Stand, Veldurthy Village and Mandal, the petitioner, Reporter of Andhra Jyothi Newspaper, resident of Veldurthy Village and Mandal, abused the 3rd respondent by touching his caste name and basing on the said complaint, the 2nd respondent registered the same as FIR No.141 of 2016 against the petitioner for the offence under Section 3(1)(s) of the SCs & STs (POA) Act, 2015 and Section 509 IPC. The main grievance of the petitioner is that few years back, the petitioner had published a news about the toddy shop and how a person died by drinking spurious liquor from there and owning to the same, one Sudhakar Goud threatened the petitioner with dire consequences and that the 3rd respondent is the employee of Sudhakar Goud and that Sudhakar Goud, due to his vengeful attitude, has instigated the 3rd respondent to prefer the complaint against the petitioner by misusing the law.

Considering the grievance of the petitioner, the 2nd respondent is directed to complete the investigation in FIR No.141 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. In case, if any charge sheet is filed and summons are received by the petitioner, he shall appear before the Court concerned and execute a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety to the

satisfaction of the concerned Court for his future appearance before the concerned Court.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 22nd November, 2016 KL
