O R D E R
The grievance of the petitioner is that vide proceedings dated 25.05.2017, he was suspended from the post of Field Assistant on the ground that he was arrested in a criminal case and till date no charge memo was issued. Under Clause 13-B(5) of the Field Assistants Human Resource Policy (F.A.H.R.P), 3rd respondent - Project Director - cum - Additional District Programme Coordinator of Mahatma Gandhi National Rural Employment Guarantee Scheme, has to conduct enquiry and pass appropriate orders within one month. Therefore, aggrieved by the action of the respondents in not conducting any enquiry and continuing the petitioner under suspension since 25.05.2017, the present writ petition is filed.
Heard the learned counsel for the petitioner and the learned Standing Counsel Sri M.S.R.Chandra Murthy for the 3rd respondent. This is a case of suspension pending inquiry. Ordinarily this court will not interfere with order of suspension pending enquiry unless same is without jurisdiction. In this case lack of jurisdiction of authority is not pleaded. Hence, this court is not inclined to interfere with the impugned order. But having regard to the above facts and circumstances and the submissions of the learned counsel, without expressing any opinion on merits, the writ petition is disposed of directing the 3rd respondent to conduct enquiry and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
