The prayer of the petitioners in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of 4th respondent herein in not issuing e-pass books (computerized) to the petitioners by way of entering their names in web-land on the application dated 05.02.2019 in respect of land bearing Sy.No.42/AA1/2 (Ac.0.20 Gts), Sy.No.42/A1/2 (Ac.0.21 Gts), Sy.No.42/A2/1 (Ac.0.18 Gts), Sy.No.42/A2/2 (Ac.0.05 Gts), Sy.No.42/AA2 (Ac.0.20 gts), Sy.No.42/AA3 (Ac.0.20 Gts), total admeasuring Acs.2.
24 Gts situated at Mokila Village, Shankarpally Mandal, Ranga Reddy District, as illegal, arbitrary, unjust, unconstitutional and in violation of principles of natural justice and also contrary to the Telangana Rights in Land and Pattadar Passbooks Act, 1971, and the Rules made thereunder and consequently direct the 4th respondent to consider the application of the petitioners dated 05.02.2019 after following the procedure strictly in accordance with law and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."
Perusal of the record reflects that the Tahsildar, Shankarpally Mandal, Ranga Reddy District, already issued proceedings dated 10.10.2018 sanctioning mutation in favour of the petitioners and others in relation to various extents of land in Mokila Village, Shankarpally Mandal, Ranga Reddy District.
The Special Power of Attorney holder of the petitioners submitted application dated 05.02.2019 to the Tahsildar, Shankarpally Mandal, Ranga Reddy District, on the strength of the aforestated mutation proceedings dated 10.10.2018 seeking issuance of e-pass books by entering the names of the petitioners in relation to the lands falling to their share in the online revenue records.
SK, J WP.No.10942 of 2019 Dt:06.6.2019 Having sanctioned the mutation under his proceedings dated 10.10.2018, it appears that the Tahsildar, Shankarpally Mandal, Ranga Reddy District, took no action upon the petitioners' application dated 05.02.2019. It is not open to the Tahsildar, Shankarpally Mandal, Ranga Reddy District, to remain unmoved upon the petitioners' application when issuance of e-pass books would be essential for availing the benefit of the Government's Rythu Bandhu scheme.
The Writ Petition is accordingly disposed of directing the Tahsildar, Shankarpally Mandal, Ranga Reddy District, to take appropriate action upon the petitioners'
application dated 05.02.2019 keeping in mind his own proceedings dated 10.10.2018. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
