HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 17152 of 2016 ORDER:

Vide present Criminal Petition, the petitioners/Accused Nos. 3 and 15 seek anticipatory bail in the event of their arrest in connection with Crime No.1062 of 2016 registered on the file of Station House Officer, Police Station, Banjara Hills for the offence punishable under Section 395 IPC.

It is an admitted fact that the petitioners filed Writ Petition No. 44952 of 2016 seeking to quash the criminal proceedings initiated against them. They also sought for stay of their arrest pending disposal of the said Writ Petition. It is also an admitted fact that in the aforesaid Writ Petition, this Court while ordering notice, however, declined to grant stay of their arrest. Thereafter the petitioners filed the present Criminal Petition pending disposal of the aforesaid Writ Petition. Inasmuch as the petitioners cannot maintain parallel proceedings for the very same relief, the present Criminal Petition is not maintainable. The Criminal Petition is therefore dismissed.
