HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CONTEMPT CASE No.766 of 2017 ORDER:

The present Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act stating that the respondents have willfully and deliberately disobeyed the order dated 30.06.2016 passed by this Court in W.P.No.21233 of 2016. 2.
A perusal of the material placed on record would show that this Court while disposing of the writ petition, directed the respondents to release the Maintenance Grants to the petitionerschool in terms of G.O.Ms.No.320, Education (PS-2) Department, dated 16.09.1994, within a period of three months from the date of receipt of a copy of the order, their inaction lead to filing of the present contempt case.

Today when the matter is taken up for hearing, learned Government Pleader for School Education, placed on record a Memo No.4550177/ PS/ A2/ 2017, dated 28.03.2017, to show that the Government accorded permission for sanction of Rs.2,74,834/ - towards maintenance grant arrears for the years 2013-2014 to 2015-2016 in respect of the petitioner's school. 4.
Having regard to the fact that the Government already sanctioned Maintenance Grants to the petitioner-school, it cannot be said that there was any violation of the order passed by this Court. Hence, the Contempt Case is closed.

Consequently, miscellaneous petitions, if any, pending shall stand closed.
