THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.9038 of 2018 ORDER:
This writ petition is filed complaining against the action of respondents 3 to 4 in interfering with the life and liberty of the petitioner, at the instance of the fifth respondent, and to direct them not to do so.

I have heard the submissions of the learned counsel for the petitioner and of the learned Government Pleader for Home (T.S). I have perused material record.

Learned counsel for the petitioner would submit that the petitioner is having a property dispute viz., a boundary dispute with the fifth respondent and that Managing Director, who is representing the fifth respondent, is a very influential person and that at his instance, the fourth respondent - Inspector of Police, Yadagiri Gutta Police Station, is regularly calling the petitioner to the police station and confining him in the police station and thereby, the petitioner is not able to institute a civil proceeding in respect of the civil dispute and that in view of such interference with the life and liberty of the petitioner, the present writ petition is filed. 4.
Learned Government Pleader for Home, on written instructions, would submit that the preliminary enquiry revealed that the dispute between the petitioner and the fifth respondent is purely civil in nature and hence, no interference was ever caused with the life and liberty of the
petitioner, as alleged in the writ petition, and that the police are not going to interfere with the life and liberty of the petitioner and that the allegations attributing overt acts to the fourth respondent are invented for the purpose of this writ petition.

Having regard to the submissions made by the learned Government Pleader, on written instructions, the writ petition is disposed of directing the fourth respondent not to call the petitioner to the police station in the absence of registration of any crime in accordance with procedure established by law.
