HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.10877 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of Mandamus declaring the action of 3rd and 4th respondents in not taking action for demarcating Petitioner on the application made on 12122017 is illegal arbitrary and unconstitutional and consequently direct the 3rd respondent to conduct the survey and fix boundaries to the land of the petitioner and also the part way on the western side and pass such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case." Perusal of the record reflects that the petitioner merely submitted a representation and that too, as long back as on 12.12.2017 to the Tahsildar, Ramannapet Mandal, Yadadri Bhuvanagiri District, requesting a survey of the lands in question.

The learned Assistant Government Pleader for Revenue, State of Telangana, would point out that as per the procedure in vogue, an application has to be submitted on-line by way of a F-line petition along with the requisite fee and supporting documents. Without adhering to the extant procedure, it is not open to the petitioner to complain of inaction on the part of the revenue authorities on a representation made nearly 1 1⁄2 years ago. The Writ Petition is accordingly disposed of permitting the petitioner to submit an application on-line by way of a F-line petition along with the requisite fee and supporting documents if he wants a survey to be undertaken of his lands. In the event such an application is made, the authorities concerned shall take appropriate action thereon in accordance with law and due procedure.

Miscellaneous Petitions pending in this Writ Petition shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date: 6th June, 2019.
