THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 26051 of 2017 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Home for the respondents. The petitioner states that he is the owner of lorry bearing No.AP 23 X 6181. He purchased it under a hire purchase agreement from Indus Ind Bank Limited. He further states that one K. Santosh took the lorry on hire basis. While so, on 13.07.2017, respondent No.3-Station House Officer, Bhoompally Police Station seized the lorry at Mothey Village alleging that one person was transporting the rice for selling the same at Hyderabad on higher price. The lorry was checked by the Sub-Inspector of Police and during the search operation, it was noticed that there were 95 bags of rice. The statements of the lorry driver and another person were recorded and the vehicle along with the goods was seized under a panchanama. Now, the proceedings are pending before respondent No.4-District Collector, Siddipet. The present writ petition is filed seeking release of the said vehicle.

The petitioner approached this Court without filing an application before the authority concerned who is seized of the matter.

In the circumstances, the writ petition is disposed of giving liberty to the petitioner to file an appropriate application seeking release of the vehicle and on such filing, it is for the authority concerned to consider the same and pass appropriate orders in accordance with law, as expeditiously as possible.
