This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.1 and 2 in Crime No.09 of 2026 of Chikkadpally Police Station, Hyderabad District, registered for the offences punishable under Section 69 of the BNS and Section 3(2)(v) of the SC ST POA Act.

The case of the prosecution is that, on 08.01.2026, the de-facto complainant lodged a report before the police stating that while she was Studying in coaching Centre, She met with the petitioner No.1 herein and they were friendly and the petitioner No.1 showed much Care and attention on her everywhere, where ever she went. In 2016, there was group II exam, the petitioner No.1 Said he belong to ST and he have many chances of clearing group II exam, as his Roommate was also ST and working in lab. He said whichever Subject She was weak, he said he will clear those doubts and help her in clearing exam By trusting his words, she agreed and went to his Room, where the petitioner No.1 showed lot of Care and attention and made her feel he is the only person who can take care of her well. He built that confidence in her.

He promised her about marriage and started taking physical time from there many times he used her physically she denied moving further but he forcefully took advantage to be in physical relation. When she started trusting him completely slowly he started ignoring her whenever she said she will inform her family he use to smoothen her and make her Peaceful all the time. Later on, slowly she realized he cheated her and used her at his best. In the year 2019, she approached his father and told about their Relationship.

said to concentrate on Studies and after getting Job, he asked us to married with that assurance, the time passed and she understood they manipulating her, she called his father many times, his father abused her saying that" He is confused how his Scn has fallen" as they don't have any history of love marriage. But after 10 month s his father married his and 2nd son to a Brahmin girl, it was love marriage. The same she have questioned to his father, then he started defaming her and abused her that she is not fit to clear any exam. When she has asked about marriage to petitioner No.1, he told her "if she marry her, his relatives will be away from him. He discriminated her caste for getting married. He mentally harassed her and cheated her these many years. Every time both son and father mace her only speak about marriage. Now, they are planning to get him married to another girl. Hence, the complainant requested for necessary action. Basing on the said complainant, the police registered a case for the above said offences.

Heard Sri Madhukar Jadav, learned counsel appearing on behalf of the petitioners as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the said allegations and the defacto complainant is in habit of lodging a report against the petitioners herein. It is further submitted that the de-facto complainant has lodged the same report on 30.10.2025 and there is no such offence punishable under Section 69 of the BNS, which is only lodged to harass the petitioners herein. It is further submitted that petitioner No.1 is the Government Employee and petitioner No.2 is the old aged person and he is also Government Employee and they are ready to cooperate with the investigating authority. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by learned counsel for petitioners stating that the allegations against the petitioners are serious in nature. It is further submitted that they tried to serve notice to respondent No.2, but she refused the same. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, it appears that, according to the de-facto complainant itself they were in relationship since 2016 and earlier, she lodged a report on 30.10.2025, but the same was not revealed in the complaint and the FIR was registered for the offences punishable under Sections 351(2), 79, r/w 3(5) of the BNS and Sections 3(1)(r), 3(2)(va) of the SC ST POA Act, which itself shows that the complainant lodged the private case and she has not mentioned about the relationship between them. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions:

i.

The petitioners shall surrender before the Station House Officer, Chikkadpally Police Station, Hyderabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- each,

with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
