HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15195 OF 2016 O R D E R :

The case of the petitioners is that they have filed an appeal in RCA No.348 of 2015 under Section 5 of Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 before the 3rd respondent on 30.01.2015 along with stay petition assailing the proceedings dated 12.05.2008 of the 4th respondent in pursuance to the orders passed by this Court in W.P.No.20554 of 2009. But the 3rd respondent did not choose to dispose of the appeal within the time stipulated by this Court and as the interim suspension granted by this Court has expired by 15.02.2015, the respondent authorities are trying to dispossess the petitioners from their land. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue.

In view of the above facts and circumstances, the 3rd respondent is directed to dispose of the appeal filed by the petitioners against the order dated 12.05.2008 within a period of three (03) months from the date of receipt of copy of this order. Till the disposal of the appeal, there shall be interim stay of dispossession.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, pending, if any shall stand closed.
