Kondapalli Venkata Rajarao v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITON No. 25573 OF 2016 ORDER:
Heard.
2. The case of the petitioners is that they are the absolute owners and possessors of land to an extent of Ac.2-93 cents in R.S.No.329/3 and Ac.3-83 cents in R.S.No.329/3 of Indugapally Village of Kotananduru Mandal, East Godavari District. While so, the respondent authorities without issuing any notice have changed the entries in the revenue records. Thereby, the petitioner has made a representation dated 01.01.2016 to the Tahsildar to enquire into the matter. Alleging inaction on the part of the respondents in taking action on the said representation, the present writ petition is filed.
3. It is well settled that as per the procedure contemplated under the ROR Act, any person aggrieved by the changes in the revenue records has to approach the recording authority seeking information with regard to the said changes. Further, the web site entry is only for the purpose of information to enable the citizens to have online access without approaching the revenue officials.
4. In the case on hand, petitioner instead of approaching the revenue officials seeking information, has straight away approached this court complaining inaction on the part of the respondent authorities. Inasmuch as the necessary procedure as contemplated under the Act is not followed, petitioner is given liberty to approach the revenue officials seeking information and after obtaining information with respect to the proceedings under
which the revenue officials have been made, he shall exercise his right in terms of the Act.
5. Accordingly, the Writ Petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
