THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1304 OF 2015 ORDER:

This Criminal Revision Case is filed by the petitioners challenging the order of the Additional Metropolitan Sessions Judge, Ranga Reddy District at L.B.Nagar dated 13.4.2014 whereby the Judge allowed the appeal filed by the wife-first respondent herein enhancing the monthly maintenance at Rs.15,000/- from Rs.2,000/- by setting aside the order of VIII Metropolitan Magistrate, Cyberabad Rajendranagar, R.R.District dated 28.4.2014 in Crl.M.P.No.1114 of 2014 in DVC No.24 of 2014.

Heard and perused the material available on record. Admittedly, the DVC is pending before the trial Court and it is yet to be disposed of. The order passed by the trial Court is interim in nature. It is now submitted by the learned counsel for the petitioners that the first petitioner is now not working in the software company as alleged by the wife-first respondent herein. It is also submitted that the first petitioner is ready to face the trial and till disposal of the DVC he is ready to pay a sum of Rs.7,500/- per month towards maintenance.

In view of the above, the order under challenge is set aside. The first petitioner herein is directed to pay a sum of Rs.7,500/- per month towards interim maintenance to the first respondent-wife on or before 10th of every succeeding month from August, 2015 till disposal of DVC No.24 of 2014. Further the first petitioner is directed to deposit all the arrears of maintenance arising out of the order of the trial Court and also the arrears arising out of the order passed in the appeal calculating

at Rs.2,000/- and Rs.7,500/- per month respectively, before the trial Court on or before 30th October, 2015. The trial Court is directed to proceed with the DVC and dispose of the same as expeditiously as possible.

With the above directions, the revision is disposed of. Consequent thereto, the Miscellaneous Petitions, if any, shall stand closed.
